Sounds like normal 5 year old behavior to me. Not staying in line? Touching new things? Not coming to sit right away when called? What is abnormal about that? I'd expect at least 25% of the class to do those things, especially on the first day! Not in a mean way, but I'd tell her that these things are normal behavior for a 5 year old child; they are not drones. Challenge her criticisms a bit. There's nothing wrong with your child's behavior. As for the crayon bit, isn't that just normal frustration? If she thinks most 5 yr olds are emotionally mature enough to express frustration in a socially acceptable manner, she's got a long road to haul. Now the assistant and the teacher know not to show your son to do something that could very well be beyond his capabilities, it was a learning lesson for the teacher. You could suggest to her methods that you've used to show your son how to express his frustration differently. This is something he is learning now, and she should be teaching him how.
