I understand the frustration you are feeling. I have a daughter who also was not diagnosed with a traditional learning disability, however, it was very apparent to every one except the school system that she needed extra help. I advocated nonstop and have finally achieved the results I was looking for, thankfully without a lawyer. My advice to you is to do the same. You should not have to pull your child out of school in order for him to get the education he deserves. Consult with a parent advocate through the Learning Disabilites Assoc. or other organization. Ask that an Education Consultant evaluate his program. Make sure that all the testing has been completed. Check out the site www.wrightslaw.com, it is very helpful.
Let me know how things are going for you.
Best Wishes, Heather
