15 and only a 5th grade level? Help

My son has been in sped is 10 years of school but he is only at a 5th grade level and the school keeps passing him right along he is going into 10th grade now and his report card was all d's and f's..and he has help in all classes? I need advice or a lawyer.. Thank you for reading.. Please email direct with any help or information.
