The daycare may not mind...but does the parent of the other infant? It's a tough decision and I would just put myself in the shoes of the parent of the other infant...would you want your child going to daycare perfectly fine and healthy and a sick child goes and gets your baby sick? Maybe that is what happened? Personally I would mind. Childrens immune systems are not fully developed at that age and being sick is not only hard on the parent but tough for the child.
