Go to the daycare and see what kind of activities he is doing to wear himself out like that. My son is 6 and goes to a center that will take him in at 6:30 (if needed) I get him there around 7ish and they feed him before busing the children off to school. He is back at the center around 4ish and they have about a 1/2 hour downtime for homework then they go either outside or go to the gym. He usually is sweating up a storm when I get him cause he is playing as hard as he can. He usually wont fall asleep till he is in bed but I've had him conk out on me a few days around 7:30 ish. He usually gets to bed around 9 and falls right asleep after reading me a book. I feel as guilty as you do but I do get a little more time in with him. Check with his Dr. as see what they might think. Thats your best bet in my opinion. Good luck and let us know what happens.
